You shall not: (i) choose or use a username or a name of another person. with the intent to impersonate that individual; (ii) use as a username, a name subject to any rights of an individual other than yourself without the appropriate authorization; or (iii) use, as a username, a name that is otherwise, offensive, vulgar, or obscene.

You agree that you are solely responsible for the activity that occurs on your account, and for keeping your account password secure. You are not permitted to use another person's user account or registration information for the services without permission.

If there is any change in your eligibility to use the services (including any changes to or revocation of any licenses from state authorities), breach of security, or unauthorized use of your account, you must notify us immediately.

You should never publish, distribute, or make known your login information for your account.

You can delete your account, either directly or through a request

made to one of our affiliates or employees. By registering your MDP Family Services account through a third-party service, such as Facebook Connect, Instagram, Pinterest, Twitter, you agree to be bound by all applicable policies of such third-party service and will act in accordance with such policies.

User Comments, Feedback And Other Submissions

You also agree to not violate any aplicable local, state, national and international laws, and regulations.
If you use scripts, bots, or any fraudulent means to obtain credits, include but not limited to setting up fake accounts and or creating more that one account per household, those credits will not be honored and MDP Family Services inc MAY PROSECUTE YOU TO THE FULL EXTENT OF THE LAW. If credits are granted because of you purchasing a product and you cancel that order; your credit will be revoked. If credits are granted because of you purchasing a product and then you return that item, your refund will be the difference minus the credit obtained from purchasing that product.
Furthermore, if you attempt to gain credits by placing orders and the cancelling or returning those or partes of those orders, your credit will not be honored. We reserve the right, at our sole discretion, to not honor credits for any reason whatsoever, including without limitation, situations where you have not obtained your credits in good faith or in compliance with these Terms of services or the spirit there of as determined by MDP Family Services, Inc.

MDP Family Services, Inc also reserve the right to access, read, preserve and disclose any information provide as we reasonably believe is necessary to (i) adhere to and comply with any applicable law, regulation, legal process, or governmental request, (ii) execute these Terms of Service, including the investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security, or any technical issues, (iv) respond to user sipper requests, or (v) protect the rights, property of safety of us, our users and the public.

Third Party Services. In general, the third-party used by us will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party services providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. Payments

Shopify Inc. hosts our store and provides us with an online e-commerce platform that allows us to sell our products and services to you.

We collect and maintain information, such as name, address, telephone number, email address, credit card information, and other data when you place an order. What do we do with that information? Your data is stored through Shopify’s data storage, date bases and the general Shopify application. They store your data on a secure server behind a security system.

When you choose a direct payment gateway to complete your purchase, Shopify stores your credit card date. It is encrypted through the Payment Card Industry Data Security Standard (PCI – DSS).

Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction is deleted. Our Terms of Conditions and Privacy Policies of the Payment Processor will apply to the processing of any payment made in addition to this agreement.

We are hereby not responsible for any error by the Payment Processor. By choosing to purchase items through the services, you agree to pay us, through the services of the Payment Processor, all charges at the prices then in effect for your purchase in accordance with the applicable payment terms.

You also authorize us, through the Payment Processor, to charge your chosen payment provider (your "Payment Method"). You agree to make your payment using that selected Payment Method.

You acknowledge and accept that we reserve the right to correct any errors or mistakes that it makes even if it has already requested or received the necessary payment.

Typographical Errors. In any case of a product being mistakenly listed on our services at an incorrect price, MDP Family Services, Inc reserves the right to refuse or cancel any orders placed for the product listed at the incorrect price. We also reserve the right to refuse or cancel any such orders whether the order has been confirmed and your credit card charged.

In the case that your credit card has already been charged for the purchase and your order are canceled, MDP Family Service, Inc. shall issue a credit to your credit card account in the amount of the incorrect price.

Risk of Loss. All items that are purchased through the site are made pursuant to a shipment contract with the supplier. This means that the risk of loss and title for such items pass to you upon delivery, MDP Family Services, Inc supplier to the carrier.

AT NO POINT IN TIME SHALL WE, NOR OUR DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS OR CONTENT PROVIDERS, BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR ANY OTHER LEGAL OR EQUITABLE THEORY WITH RESPECT TO THE SERVICES (I) FOR ANY LOST PROFITS, DATA LOSS, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, COMPENSATORY OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER, SUBSTITUTE GOODS OR SERVICES (HOWEVER ARISING), (II) FOR ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE (REGARDLESS OF THE SOURCE OF ORIGINATION), OR (III) FOR ANY DIRECT DAMAGES IN EXCESS OF (IN THE AGGREGATE) OF THE GREATER OF (A) FEES PAID TO US FOR THE PARTICULAR SERVICES DURING THE IMMEDIATELY PREVIOUS THREE (3) MONTH PERIOD OR (B) $500.00.

Governing Law and Jurisdiction. Our Terms of Service shall be governed by and interpreted in accordance with the laws of the State of New York, including its conflicts of law rules, and the United States of America. You are in agreement that any dispute arising from or relating to the subject matter of these Terms of Service shall be governed by the exclusive jurisdiction and venue of the state and Federal courts of New York County, New York.

Modification. MDP Family Services, Inc. maintains the right, in our sole discretion, to change or replace any of these Terms of Service, or modify, suspend, or discontinue the services (including without limitation, the availability of any feature, database, or content) at any time by posting a notice on the site or by sending you notice through the services, via e-mail or by another appropriate means of electronic communication. If you are in objection to these Terms, do not accept and utilize the services. We may also impose limits on certain features and services or restrict your access to parts or all the services without notice or liability. Out of consideration, MDP Family Services, Inc will attempt to provide timely notice of modifications. It is also your responsibility to check these Terms of Service periodically for changes. If you choose to continue accessing/utilizing the services following the notification of any changes to these Terms of Service, this constitutes acceptance of those changes.

Miscellaneous

Entire Agreement and Severability. These Terms of Service stand to represent the entire agreement between you and MDP Family Services, Inc. with respect to the services we offer, including use of the Site, and supersedes all prior or contemporaneous communications and proposals (whether oral, written or electronic) between you and us with respect to the services. Assignment. These Terms of Service are not assignable, transferable or sublicensable by you except with our prior written consent and are considered personal to you. Without consent, we may assign, transfer or delegate any of our rights and obligations hereunder.

Agency. No agency, partnership, joint venture, or employment relationship is created because of these Terms of Service and neither party has any authority of any kind to bind the other in any respect.

Notices. Authorized Distributor and Warranty Statement

MDP Family Services, Inc is passionately committed to providing our customers with safe and reliable products through authorized dealers. Unfortunately, MDP Family Services products are sometimes sold by companies that are not authorized to do so. Goods sold by these unauthorized companies may not always be purchased from MDP Family Services, Inc. Due to the nature of the goods sold by unauthorized distributors and their business practices, products sold by unauthorized distributors are not entitled to MDP Family Services warranty coverage. We are using our best efforts (including this warning) to prohibit these companies from taking advantage of consumers, but these practices still exist. We urge you to use diligence when selecting a dealer to make your purchase.

Our policy is to honor product warranties only on products purchased from MDP Family Services, or an authorized MDP Family Services dealer and only accompanied by a receipt or proof of purchase. If you purchase a MDP Family Services product from an unauthorized dealer or if the original serial number has been removed, defaced, or altered, your MDP Family Services warranty will not be valid.

Restrictions

You are prohibited from, and expressly agree that you will not sell, resell, or make commercial use of the MDP Family Services brand and any finished product both domestically and/or internationally, unless you have an executed agreement with us that expressly allows for such activity. You may not access or use any MDP Family Services product in violation of United States export control and economic sanctions requirements nor use our registered trademarks and images to resell our brand on the internet, offer discounts below MSRP, or cause the MDP Family Services brand or any product to be diluted in any way.

By placing an order from MDP Family Services website, you agree that this purchase is for personal use only and not for resale or commercial purposes and waive all rights to protections by the “First Sale Doctrine”.
